China RoHS
China's RoHS was promulgated on February 28, 2006 and officially came into force on March 1, 2007. The administrative measures determine the control of six toxic and harmful substances contained in electronic information products, such as lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB) and polybrominated diphenyl ethers (PBDE), and adopt the method of catalogue management to promote the prohibition or restriction of their use step by step. In order to cooperate with the effective development and implementation of relevant work in the management measures, the implementation opinions on the national unified implementation of voluntary certification for pollution control of electronic information products and the national unified implementation rules for voluntary certification for pollution control of electronic information products have been issued successively, and the implementation rules have made clear Provisions on certification standards and technical specifications.
China RoHS 2.0
On January 6, 2016, the Ministry of industry and information technology, the development and Reform Commission, the Ministry of science and technology, the Ministry of finance, the Ministry of environmental protection, the Ministry of Commerce, the General Administration of customs and the General Administration of quality supervision, inspection and Quarantine jointly promulgated the administrative measures for the restriction of the use of hazardous substances in electrical and electronic products (Order No. 32, hereinafter referred to as the measures). The management method has been officially implemented since July 1, 2016. This new management method is also known as China RoHS 2.0, but its essence is China RoHS.
The administrative measures for limiting the use of hazardous substances in electrical and electronic products are different from the measures for pollution control of electronic information products published in February 2006. Major adjustments have been made in terms of scope of application and management methods for limiting the use of hazardous substances.
In February 2006, the former Ministry of information industry and other seven departments jointly formulated the administrative measures for pollution control of electronic information products (hereinafter referred to as order 39), which requires the control of harmful substances in electronic information products. However, with the development of the industry, order 39 gradually highlighted its limitations, so a new "method" was formulated. And from July 1, 2016, the implementation date of the new measures, order No. 39 will be repealed.
Differences between the newly issued China RoHS measures and Decree No. 39
1、 Expand the scope of application of the regulations and modify the names of the regulations accordingly. The measures expanded the adjustment object from electronic information products to electrical and electronic products, and revised the name of the regulations to the administrative measures for the restriction of the use of hazardous substances in electrical and electronic products. At the same time, the Measures stipulate the meaning of "electrical and electronic products".
2、 Expand the scope of hazardous substances restricted. Based on the RoHS directive of the European Union and the common practices of other countries, the measures have increased the use of hazardous substances restricted, modified lead, mercury and cadmium into lead and its compounds, mercury and its compounds, cadmium and its compounds, and modified hexavalent chromium into hexavalent chromium compounds.
3、 Add provisions on science, technology and financial policy support. The measures stipulates that the State encourages and supports scientific research, technological development and international cooperation on the restricted use of hazardous substances in electrical and electronic products, and actively promotes technologies and equipment such as the substitution and reduction of hazardous substances in electrical and electronic products.
4、 Improve the management mode of limiting the use of harmful substances in products. The restricted use of hazardous substances in electrical and electronic products adopts the method of catalog management. 7 departments such as the Ministry of industry and information technology and the national development and Reform Commission shall prepare the standard management catalog, and no key management Catalog shall be prepared. At the same time, a conformity assessment system shall be established to manage the electrical and electronic products included in the compliance management catalogue according to the conformity assessment system. The conformity assessment system shall be formulated by CNCA in accordance with the suggestions of the Ministry of industry and information technology and in conjunction with the Ministry of industry and information technology. The Ministry of industry and information technology, together with the Ministry of Finance and other departments, shall establish relevant acceptance mechanisms for the conformity assessment results according to the actual situation.

Similarities between China's RoHS and EU RoHS
1. Both China's RoHS and EU ROHS are legal normative documents with certain coercive force.
China's RoHS is a departmental regulation and a kind of Chinese legal system. Therefore, it has certain legal effect. After the entry into force of China's RoHS, the production, sales and import of electronic information products in China shall be subject to China's RoHS. EU ROHS directive is also a kind of EU legal system, which is compulsorily binding on EU Member States. Moreover, the EU ROHS directive is a single market decree, and all Member States must convert it into their corresponding laws in accordance with the requirements of the EU ROHS regulations.
2. The main purpose of legislation is to limit the use of some harmful substances in products, so as to reduce the environmental pollution caused by product abandonment.

Differences between China RoHS and EU RoHS
1. Different control locations:For electronic information products sold in China, only China RoHS is required, while EU ROHS controls all electronic and electrical products sold in the EU.
2. Different control methods:China RoHS lists the electronic information products that can be monitored one by one and compiles them into a directory for management, supervision and control. If your products are in this directory, you must do China ROHS certification; EU ROHS will first bring all electronic and electrical products into the scope of supervision, and then exempt some products that cannot be implemented in accordance with ROHS requirements at this stage.
3. Different control object ranges:The control object of China's RoHS is electronic information products; EU ROHS regulates and controls 10 categories of electronic and electrical products with AC 1500V and DC below 1000V, except for military and space use. The products corresponding to the two do not necessarily coincide.
4. Restricted substances differ:The number of restricted substances certified by EU ROHS has increased from to 10: lead, mercury, cadmium, hexavalent chromium, brominated biphenyl, polybrominated diphenyl ether, Dihexyl phthalate (2-ethylhexyl) ester (DEHP), toluene butyl phthalate (BBP), dibutyl phthalate (DBP) and diisobutyl phthalate (DiBP). The hazardous substances restricted in China's ROHS certification include lead and its compounds, mercury and its compounds, cadmium and its compounds, hexavalent chromium compounds, polybrominated biphenyls (PBB), polybrominated diphenyl ethers (PBDE), and other hazardous substances specified by the state.
5. Different marking requirements:EU ROHS has no labeling requirements; China RoHS shall mark the environmental protection service life, toxic and harmful substances contained in products and the name of packaging materials.
At present, the toxic and harmful substances restricted by China's RoHS and EU ROHS are the same, and the limit requirements are also the same.Special note: China's RoHS is not exempted at present.
